Pa Dep Consent Order and Agreement
Since 2004, municipalities have been working with the support of 3RWW to meet the compliance requirements of consent orders. Detailed timelines show compliance activities from 2004 to 2015. The long-term rainfall control plan, to be jointly developed by the municipalities and ALCOSAN, is to address the sustainable operation and maintenance of the region`s wastewater treatment infrastructure by 2046. Municipalities should expect that in the future, regulators will require the implementation of the approved wetland plan through a legally enforceable agreement or by-law. Municipalities that operate a combined sewer system (transporting wastewater and rainwater in the same pipes) have received an « order and consent agreement » from the CED. Municipalities with a separate sanitary sewer system (wastewater and rainwater are transported in two separate systems) have received a « consent administrative order », which is enforced by the CCA. The ordinances end in 2015 and require municipalities to carry out the following activities: In January 2004, municipalities in the ALCOSAN coverage area signed municipal consent orders for the assessment and long-term planning of wastewater infrastructure in our region. Under the Municipal Consent Ordinances, the Environmental Protection Agency transferred enforcement responsibility to the Pennsylvania Department of Environmental Protection (PED) and the Allegheny County Department of Health (ACHD). .
