14. WEATHER. In case of rain forecast for outdoor rental, the customer can cancel order 3 for upholstered furniture, dining chairs, coffee tables and side tables 24 to 48 hours before the scheduled delivery of the rental. Payment of the balance of these rental items will be refunded, but not the initial 50% deposit. The exemption of damage is secondary to the customer`s own insurance. Some home and business insurance policies can cover damage to rented items. Check with an agent or broker to see if such coverage exists. If the waiver of damages is accepted, Customer agrees to exercise all available rights under Customer`s insurance coverage and assign all claims and proceeds of insurance coverage to Something Vintage Rentals, LLC. Damage Waiver releases the customer from liability for rented items that are returned damaged. If damaged items are not returned, proof of the damaged items must be provided, and other evidence such as Something Vintage Rentals, LLC may reasonably require. Waiver of damages is not covered for damages due to negligence or abuse. (Example: Rented items that were left uncovered and unprotected in the rain) Damage Waiver does not release any liability for losses caused by negligence, abuse, vandalism, theft, mysterious or inexplicable disappearance or defect. The Customer undertakes, upon request, to provide a written and signed police report submitted by the Customer in connection with such an event.

The Customer acknowledges that the Rental Property has a size, design and capacity chosen by the Customer and that Something Vintage Rentals, LLC disclaims all warranties, express or implied, with respect to the Rental Property, including any express or implied warranties as to condition, fitness for a particular purpose or durability. In no event shall Anything Vintage Rentals, LLC be liable for any incidental, special, punitive or consequential damages arising out of or in connection with the Rental Property. Customer 45K indemnifies Something Vintage Rentals, LLC from and against all claims, suits, damages and liabilities, including attorneys` fees, arising out of or in connection with Customer`s use and possession of the Rental Property. 4 Section II. Rental order 1. The customer accepts that changes to the number of plates, cutlery, glassware, bed linen, tables and chairs must not exceed a 10% decrease in the number. The customer may not hand over possession of the rental property to persons other than the employees of Something Vintage Rentals and requires proper identification of such persons before handing over the property. 12. Customer acknowledges that The In-Stock Items of Something Vintage Rentals, LLC are unique items. Something Vintage Rentals, LLC is not responsible in the event that inventory is no longer available due to loss or damage caused directly or indirectly to the rental item.
